TERMS & CONDITIONS

    PRIVACY & CONFIDENTIALITY

Intercept Investigations tenaciously guards the privacy and confidentiality of our customers, and NEVER sells or otherwise distributes personal, business, identifying or any other specific information regarding our customers to unauthorized third parties.  The information that we provide to other entities is supplied only to those individuals and/or businesses that absolutely require the information in order for Intercept Investigations to provide authorized services and/or products to our customers.

Exceptions to this policy may include any demand for information received by Intercept Investigations which is made by means of a lawful subpoena, or the provision of information to the appropriate law enforcement agency upon the reasonable determination of Intercept Investigations that a crime has been or may be committed.

    METHODS OF PAYMENT

    CREDIT CARDS

Intercept Investigations accepts Visa, MasterCard and Discover credit cards.  In order to protect Intercept Investigations and our customers from fraud, equipment orders paid for by credit card will be shipped only to the credit card billing address appearing on your monthly statement.  If you would like your equipment order shipped to another address, you must first contact the credit card issuer in order for them to authorize an 'alternate shipping address'.

For the protection of everyone concerned, credit card billing information will be verified prior to processing equipment orders.  When processing credit cards, we will verify the billing address and security code, and any unverifiable information or other irregularities may result in a significant delay of your equipment order.

Because of a few past problems, credit cards are not accepted for international investigation assignments or equipment orders.  All orders for equipment that will be delivered outside the United States, must be paid for in advance via bank wire transfer (see 'Bank Wire Transfer' below) or a Cashier's Check drawn on a recognized United States Financial Institution.

    MONEY ORDERS & CASHIER’S CHECKS

Orders paid for using a Money Order or Cashier’s Check from a recognized institution (United States Postal Service, American Express, Major Banks, etc.) will be accepted without resulting in a delay equipment order being processed.  Unfortunately, due to past difficulties caused by a few 'unscrupulous' individuals, we are unable to accept Personal Checks, Business Checks, or COD's.  Purchase Orders are accepted from official government agencies and select recognized businesses only, with prior authorization.

    BANK WIRE TRANSFER

Orders for equipment are accepted for payment through Financial Institution (Bank) Wire Transfers.  Instructions regarding Wire Transfers will be provided upon request.  A confirmation of the wire transfer must be received by Intercept Investigations prior to the processing of any order, or the shipment of any equipment.

Intercept Investigations' bank or an intermediate financial institution processing the wire transfer, may impose up to a $20.00 fee on some domestic & international wire transfers.  These fees, charged by our bank or the intermediate financial institution, are in addition to any fees charged by the customer's bank.  All wire transfer fees must be paid by the customer.

    EQUIPMENT SALES

    AVAILABILITY OF EQUIPMENT

Although Intercept Investigations endeavors to have all items in stock and available for immediate shipment, this simply is not possible.  If an order is received for an item that is not available for immediate shipment, notification will be provided regarding the current state of your order, and the anticipated shipping date.  Generally, if an item is not available for immediate shipment, the item will generally be in stock and available for shipment within 2 to 5 business days.

In those circumstances that require us to special order or custom build a piece of equipment, a longer shipment delay may be required.  However, if for any reason the order will not be shipped within the 2 to 5 business day period referenced above, you will be notified in advance, usually within 24 hours of the receipt of your order.

While all advertised equipment is available at the time of publication, some items may from time to time be discontinued or otherwise out of stock, and may be temporarily or permanently unavailable.  Regarding any piece of equipment described as 'used', 'sample', 'demonstrator' or 'closeout', we are unable to guarantee the availability of these items, as our stock may be extremely limited.

Any and all such 'used', 'sample', 'demonstrator' or 'closeout' equipment is sold on a 'first come - first served' basis, with preference being afforded to the first individual to present a valid form of payment.  Unless provided with specific written assurance that any equipment will be held pending receipt of payment, no such assurance is offered or otherwise inferred.

    SHIPPING & HANDLING

Domestic equipment orders are available for shipment via FedEx.  All international orders are shipped via United States Postal Service International Express Mail.  Please be certain to include your complete street address and daytime telephone number for delivery.  All equipment orders require a signature upon delivery, unless a signature liability release has been completed prior to the shipment of your order, in which case the CUSTOMER accepts all liability for missing or lost shipments.

If you provide your delivery service account number, we may (solely at our discretion) agree to ship the order via the delivery service of your choice (FedEx, UPS, Airborne, DHL, etc.).

It is not our policy to charge exorbitant 'handling' charges like many other businesses.  Some businesses will sell you a piece of equipment, and then charge you an 'arm and a leg' for delivery, making an additional hidden profit for themselves.  Generally speaking, our shipping charges are limited to our actual or estimated actual cost, and in some cases, our actual cost of the shipping exceeds the amount that we charge.

Nearly every piece of equipment that we sell is available for delivery within the contiguous United States with a flat-rate $15.00 FedEx  Ground shipping option.  Regardless of the actual cost that we incur to ship the item, we will charge you only $15.00, and that amount even includes insurance to provide protection against loss or damage.  However, if you need your order delivered sooner, we also offer other various options, all at our estimated actual cost.

    WARRANTY INFORMATION

Intercept Investigations supports all manufacturer's warranties of the equipment we sell.  These manufacturers warranty that their products will be free from defects in materials and workmanship during the warranty period (generally 30 days to five years - depending upon the item - see the manufacturer’s warranty statement enclosed with each item).

Defects determined to be caused by alteration, modification, misuse, abuse, accident, negligence, improper installation, reverse power polarity, failure to adhere to operating instructions, repairs or attempted repairs, a lack of or improper maintenance, or any other cause beyond the control of Intercept Investigations are not covered by this warranty.

Intercept Investigations assumes no liability for damage to persons or property, or for consequential damages or loss of income, production or good will resulting from the use or misuse or inability to use the equipment by the purchaser or others.

Intercept Investigations offers no warranty on equipment other than those offered by the manufacturer.  There are absolutely no warranties which extend beyond the description described herein, either as to merchantability or fitness for a particular purpose.  Shipping charges are NOT covered under this limited warranty, and are the responsibility of the customer.

    REPAIR POLICY

If you need to return equipment for repair, please call the telephone number provided by the manufacture with the item of equipment purchased.  If you are unable to contact the manufacture, you MUST call (702) 547-5200 to obtain a Return Merchandise Authorization (RMA) number PRIOR to returning the equipment.  The RMA number must appear plainly visible on the outside of the package above our name and address or the shipment will not be accepted.

CUSTOMER IS RESPONSIBLE FOR ALL SHIPPING & INSURANCE CHARGES.

    DESCRIPTION OF EQUIPMENT

Every effort has been made to accurately describe the equipment offered for sale, but we cannot be held liable for unintentional errors.  Please bring to our attention any errors that you discover, so that they can be corrected as soon as possible.  As the manufacturers of the various pieces of equipment constantly strive to upgrade their products, the actual product may be slightly different than the description and/or appear slightly different than depicted in the photo.  Specifications and prices listed on our web site are subject to change without notice.

    TECHNICAL SUPPORT

Technical support is furnished with the express understanding and agreement that such support does not invalidate the terms of the warranty information above, including with respect to the provisions regarding merchantability or fitness for a particular purpose.

Although the capabilities of various pieces of equipment will vary depending upon environmental and other factors, Intercept Investigations will attempt to provide sound advice regarding the capabilities of the equipment we sell.  However, due to unforeseen circumstances and other conditions beyond our control, we are unable to guarantee the capabilities of any equipment, including but not limited to, the range of transmitters, receivers, infrared illuminators, or any other electronic equipment.

Intercept Investigations will, upon request, provide all available information on any piece of equipment, and if requested, will provide to the best of our ability, advice concerning that equipment, but cannot be held responsible for situations of any type or manner caused by any customer who disregards any or all of our advice.

IMPORT & EXPORT OF RESTRICTED ITEMS

Some of the equipment offered for sale by Intercept Investigations (including, but not necessarily limited to voice, fax and/or data scrambling or encryption, and/or night vision equipment) may require an export license from the U.S. Department of Commerce and/or the U.S. Department of State.

Intercept Investigations will not ship any equipment requiring an export license to any destination outside of the United States.  If the customer desires to ship any equipment requiring an export license to any destination outside of the United States, the customer accepts sole responsibility for obtaining the proper export license and for shipping the properly licensed equipment.

    LAW ENFORCEMENT EQUIPMENT

In accordance with USC Title 18, Part I, Chapter 119, Sections 2510, 2511 and 2512, all equipment contained within this web site or otherwise available for sale by Intercept Investigations, identified by an item number that starts with the letter "L" is NOT available for sale to the general public, and is NOT available for export outside the United States.  The presence of an image and/or description of any such equipment is merely a proprietary notice, and does NOT constitute an offer to sell such equipment, as evidenced by the absence of any pricing information.

Price quotes for this type of restricted equipment will be provided only to authorized representatives of a government agency of the United States, or a political subdivision thereof, after a written inquiry or other satisfactory confirmation of identity has been received.  Sales of this type of restricted equipment will be made only to government agencies of the United States, or a political subdivision thereof, and only after receipt of a signed purchase order or other acceptable contract.

    RETURN POLICY

Given the amount of information available (both on our web site and by telephone), we must assume that once a customer places an order that customer has made an informed decision and has determined that a particular piece of equipment is appropriate for the intended application.  All equipment is special ordered by the person placing the order, and equipment orders are NOT subject to cancellation at any time following acknowledgement of that order.

Furthermore, there are occasionally situations where a customer decides to 'experiment' by making modifications to a piece of equipment or has only a 'short-term need' and attempts to return a perfect piece of equipment after it has served its purpose.  It is unfortunate that a few 'unscrupulous' individuals must ruin things for the majority.

Therefore, our policy concerning equipment returns, exchanges or refunds is as follows:

ALL SALES ARE FINAL.  NO CANCELLATIONS.  NO REFUNDS.  NO EXCHANGES.  NO CREDITS.  NO EXCEPTIONS.

    USE OF EQUIPMENT

Equipment offered for sale within this web site is not to be used for the unauthorized surreptitious interception of oral communications.  All equipment is sold subject to USC Title 18, Part I, Chapter 119, Section 2510, 2511 & 2512, and any other local, state or federal law or regulation.  Federal law and some states provide strict penalties including fines and/or imprisonment for using this equipment in any manner other than that prescribed by law.

Intercept Investigations offers no advice or guarantee regarding the legality of any products or their possible or intended uses.  It is the responsibility of the purchaser and/or user of the equipment to check local, state and federal laws prior to engaging in any surveillance or other surreptitious monitoring and to obtain any required licenses prior to operating any radio transmitter for which a license may be required.

By placing an order for any equipment offered within this site, customer states:

    1.  I am at least 18 years of age at the time this order is placed.

    2.  I will not use, nor authorize the use of any equipment ordered from this site in any manner which is contrary to any applicable local, state or federal law governing such use.

    3.  I am aware of all applicable laws and regulations concerning the use and/or export of the equipment ordered from this site.

    4.  I will defend, indemnify and hold harmless, Intercept Investigations, from any and all claims or actions (including reasonable attorney’s fees) brought against Intercept Investigations in connection with any use of the equipment that I have purchased, which is utilized in any manner contrary to any law or regulation.

The products listed on Intercept Investigations web site are offered for sale and are intended for legal purposes only.  It is the sole responsibility of the customer to determine the appropriateness of any equipment, and to check all applicable local, state, and federal regulations prior to purchase and/or use.  Intercept Investigations will not be held responsible for any illegal possession and/or use of any equipment sold.  Intercept Investigations reserves the right to refuse shipment to any person for any reason.
